It is not a new demand among energy companies to reduce and simplify the procedures for carrying out their renewable energy projects throughout Spain, a country that is supposedly committed to the energy transition, but that bureaucracy and administrative obstacles can become a major obstacle to the development of many of these projects.
The loss of administrative authorisations already granted can occur due to the expiry of permits for access and connection to the transmission grid of the installation that have not managed to accredit the administrative milestone of construction in due time and form, as the path towards achieving this is often not without obstacles, due to the modifications and final configurations of both the installation itself and its evacuation line caused by the different allegations presented by the public bodies and administrations involved.
In the event of an unfavourable resolution, such as the loss of the access and connection point, the promoter may lodge the appropriate appeal with the corresponding body within a period of one month.
This expiry of the permits due to the lack of accreditation in due time and form highlights the need for a more in-depth analysis of the possible impacts on the sector, since that “so long ago’ ” RD8/2023 of 23 December granted an additional 6-month extension of the deadline,i.e. until 25 July 2024, This date may have been viewed favourably by the majority of those in the sector, as it gave them more time to accredit the milestones set out in RD1183/2020, given that several million euros deposited in surety bonds or guarantees are at stake.
Let us hope that the Ministry led by Ribera continues to support the sector, following the recent authorisation for the construction of almost three hundred renewable energy projects, which will cost several billion euros over the next three years, otherwise many of the promoters and builders in this sector will see their medium-term viability plans undermined.
